حق هويت بمثابه حق بشري؛ حق هويت و آذربايجان (بررسي حقوق ايران در دوره ي بعد از انقلاب 1357 )* آرتا ساوالانلي[1]ائلدار سوجا[2] تقديم به فريدون ابراهيمي حقوقدان و دادستان كل آذربايجان كه بدست رژيم ديكتاتور و نژادپرست پهلوي اعدام گرديد. مقدمه: ورود به دوران حقوق مدرن آغاز مصائب عظيمي براي ملت آذربايجان بود. اگرچه اولين متن مدون حقوقي برآمده از انقلاب بزرگ مشروطيت، اصولي مانند انجمن ايالتي و ولايتي را براي تداوم فدراليسم سنتي پيش بيني کرده بود اما اصول کافي را براي حمايت از زبان و فرهنگهاي گوناگون ايران تدارک نديده بود. آذربايجان، پيش از دوران مشروطيت اگر چه از لحاظ حقوقي جزئي از پادشاهي قاجار محسوب مي شد اما بصورت دوفاکتو –عملا– از استقلال سياسي، اقتصادي و فرهنگي در برابر ايالت مرکزي برخوردار بود و هويت قومي تورکي در کنار هويت مذهبي شيعي دو ستون حيات اين ملت را تشکيل مي دادند. با وقوع انقلاب مشروطيت که به دلايل اقتصادي، سياسي و تاريخي خاستگاه آن عمدتا آذربايجان و بويژه تبريز بود، اولين متن قانون اساسي با توشيح پادشاه قاجار به رشته تدوين درآمد و بدين ترتيب انقلابي که بر عليه استبداد و با اميد کسب آزاديهاي بيشتر به وقوع پيوسته بود، آرمانهاي خود را در اصول قانون اساسي متجلي کرد. حقوق زباني و قومي که به نظر انقلابيون آرمانگرا غير قابل مناقشه مي نمود در اصول قانون اساسي مشروطيت به سکوت برگزار شد. با ظهور رضاخان بر بستري از ناکاميهاي انقلاب مشروطيت و زمينه هاي مساعد نظام بين الملل، دوره جديدي در حيات آذربايجان شروع شد. ايدئولوژي وي که توسط فرزندش نيز به شدت دنبال شد پان ايرانيسم مبتني بر فارس گرايي افراطي، برتري نژاد آريايي و احياي پادشاهي ايران باستان بود. ... ادامه مطلب |

Report of Amnesty international about Reza Daghestani, South Azerbaijani right activist, student and Journalist PUBLIC AI Index: MDE 13/040/2008 6 March 2008 UA 58/08 Fear of Torture IRAN Reza Daghestani (m), aged 27, Azerbaijani rights activist, student, journalist Azerbaijani rights activist Reza Daghestani was arrested on 21 February 2008 at his family^s house in the city of He called his family the following day to tell them he was being held in a detention centre belonging to the Ministry of Intelligence in Oroumiye. He may have been tortured to force him to provide information, as security forces searched his house a second time on 26 February and appeared to know where to find other papers and books. Reza Daghestani has had no access to a lawyer. His family, who are very religious, have been told he is accused of defamation of the Prophet. It is not clear what this accusation relates to, and there are fears that his family may have been told this so that they would withdraw their support for him. Amnesty International believes he is a prisoner of conscience held solely on account of his peaceful activities on behalf of Iranian Azerbaijanis. His family tried to visit him on 25 February, but were not allowed. They have been told that Reza Daghestani will not be allowed to receive visits until at least 10 March. Reza Daghestani is the editor of a student newsletter, Chamlibel, published in both Azerbaijani Turkic and Persian and he has written for several other publications. His other activities have included starting a series of Azerbaijani Turkic classes in the town of He was a member of the committee of a campaign group called Urmu Azerbaijan Sesi, which actively supported several would-be candidates from Oroumiye who all were disqualified from standing for the Majles (parliament) elections to be held on 14 March. Urmu Azerbaijan Sesi issued a public statement objecting to the “unfair and undemocratic disqualification of its candidates”.
